A/HRC/13/34
63.
States are expected to observe minimum procedural standards in order to
ensure that decisions concerning the acquisition, deprivation or change of nationality
do not contain any element of arbitrariness. In particular, States should ensure that a
review process can be carried out by a competent jurisdiction of an administrative or
judicial nature in conformity with the internal law of each State and the relevant
international human rights standards.
64.
States should ensure that an effective remedy is available to persons whose
right to a nationality has been violated.
65.
The above principles on the right to nationality, as well as the rules concerning
the prohibition of arbitrary deprivation of nationality, the principle of nondiscrimination, the avoidance of statelessness and the requirement of procedural
guarantees and effective remedies are also fully applicable to situations of State
succession.
