Recommendations A/HRC/33/51/Add.2 Measures taken/current situation Level of implementation and observations (to be completed by the WGEID) recommendations to the State to ensure that state officials including members of the armed forces and police who are named as suspects or accused in criminal actions relating to abductions and enforced disappearances are not transferred, promoted or offered any other office in the armed forces, police or public service while cases against them are pending.47 The OMP has initiated follow up with relevant state authorities including the Ministry of Defence, Sri Lanka Police, Army, Navy and Air Force concerning the implementation of these recommendations. perpetrators of disappearances, irrespective of military rank or official position. It also calls on the Government to follow the OMP’s recommendation to expedite and give highest priority and adequate resources to prosecutions and other ongoing cases involving enforced disappearances. Situation during the visit A/HRC/33/51/Ad d.2 Amnesty Amnesty International is not aware of any new efforts on this front. Centre for Justice and Change The independence of the Attorney General department is still questionable. Of the emblematic cases Only one case in Colombo Magistrate court has progressed well. Others are on hold. Is the delay on the part of the investigators or the Attorney General is not clear. Families of the Disappeared Still the feeling is that Attorney General is not independent. He has not indicted the accused of the cases related to disappearance yet. There is a big pressure on the government to not to take any legal action against the suspected Armed forces officers. After Easter Sunday’s tragedy, even a Buddhist chapter issued a statement requesting the government to release the officers of intelligence units who are in prison with the accusation of the involvements with disappearances cases. The Government is hesitating to release any document on surrenders especially on this regard. Opposition including Mahinda Rajapaksa and some extremists Buddhist monks take this issue of taking action against the suspects in armed forces, saying that they did great service through their intelligence network. Government is also not facing this challenges well. Even the President himself is against taking action against so called war heroes. 39 47 OMP Interim Report, above n 2, para 47(k).
