The Special Rapporteur considered that it was more appropriate not to present an average of public defenders per inhabitant given that 85 per cent of the participating States do not have a public defender’s office and that legal aid is provided by lawyers directly. In many States, legal assistance is provided free of charge by appointed lawyers (through legal aid programmes), who are paid by the Government to promote defence at trial or to protect people’s rights. 29. The option to present the highest, lowest and average number of people per judge, prosecutor and lawyer was preferred in order to avoid giving a false impression that the average found in the present study was adequate to ensure good administration of justice. 8
