A/HRC/43/2
823. At its 32nd meeting, on 12 March 2020, the Human Rights Council considered and
adopted the outcome of the review of Egypt (see section C below).
824. The outcome of the review of Egypt comprises the report of the Working Group on
the Universal Periodic Review (A/HRC/43/16) and the views of Egypt concerning the
recommendations and/or conclusions, as well as its voluntary commitments and its replies to
questions or issues that were not sufficiently addressed during the interactive dialogue in the
Working Group, and which were presented before the adoption of the outcome by the plenary
(see also A/HRC/43/16/Add.1).
1.
Views expressed by the State under review on the recommendations and/or
conclusions, its voluntary commitments and the outcome
825. Egypt reaffirmed its belief in the universal periodic review process as a platform for
constructive dialogue, sharing best practices and strengthening States’ abilities to fulfil their
obligations, without politicisation or selectivity.
826. The 2014 Constitution establishes respect for human rights and fundamental freedoms
as the foundation of the political system, and makes laws related to the rights contained
therein supplementary to it. Equality before the law and the rule of law are peremptory norms
(jus cogens). The Constitution also affirms the importance of partnership with civil society,
a matter that the Government highly values, as reflected in the consultations on drafting the
national report and considering universal periodic review recommendations.
827. Having consulted the National Council for Human Rights, 87.37 per cent of the
recommendations were accepted: 270 enjoyed support; 24 were already implemented; 31
were partially accepted; and 30 were not supported. Two were categorically rejected for
containing politicised and incorrect allegations hostile to Egypt and its people, in breach of
universal periodic review principles. 15 were inaccurately formulated and deemed factually
incorrect. Explanations of position were made in document A/HRC/43/16/Add.1. The newly
created Supreme Standing Human Rights Committee will draw the necessary policies and
measures for implementation and follow up. Civil society partnership is key in this regard.
828. Most recommendations provide important guidance for the national human rights
strategy in the coming years.
829. Positions on international human rights instruments and reservations thereon are
periodically reviewed, in line with the Constitution and internationally recognised human
rights. The Constitution binds to the provisions of international treaties ratified, same as
domestic laws. Those harmed by non-application have the right to resort to the judiciary.
Human rights treaties ratified have a special status, and the rights and freedoms contained
therein enjoy the protection prescribed to constitutional rules.
830. The Constitution specifies unequivocal guarantees, thereby making human rights
uninterruptable and non-derogable. The National Council for Human Rights is entitled to
report violations thereof. Any aggression on the liberty of the person or other constitutionallysafeguarded rights is an imprescriptible crime. Efforts are underway to reinforce institutional
and legislative structures, and to review laws to ensure their concurrence with the
Constitution and obligations under international human rights law.
831. Egypt is keen on cooperating with treaty-bodies, the Human Rights Council and its
mechanisms. A mandate-holder visited in late 2018, and invitations were extended to six
more, who are yet to propose dates. In order to ensure proper preparation, other visit requests
will be subsequently considered. Egypt is also keen on maintaining regular contacts with
mandate-holders, and on responding to their communications. It attaches special attention to
encouraging civil society cooperation with the Human Rights Council and its mechanisms,
and rejects intimidation or reprisals against civil society representatives.
