A/HRC/43/2
878. As for the three recommendations that Bosnia and Herzegovina has not accepted, the
Constitutional Court of Bosnia and Herzegovina issued a decision repealing the provision of
death penalty in the Republika Srpska Constitution, which fully complies with one of the
recommendations from the universal periodic review third cycle and for that reason it has not
been accepted. Furthermore, when it comes to equal access to and the valid legal framework
of education by persons belonging to national minorities in Bosnia and Herzegovina, this
right has been afforded to them and therefore the position of Bosnia and Herzegovina was to
not accept this recommendation.
879. With regard to the recommendation regarding harmonization of Bosnia and
Herzegovina legislation against discrimination on the grounds of sexual orientation or gender
identity, the harmonization has already been carried out through the Law on Gender Equality
of Bosnia and Herzegovina and the Law on Prohibition of Discrimination of Bosnia and
Herzegovina, which apply throughout Bosnia and Herzegovina.
880. In terms of recommendations which were in the process of implementation, the
process of amending the criminal codes in Bosnia and Herzegovina to prohibit incitement of
racial, national and religious hatred and hatred on other grounds has been partially completed.
Furthermore, initiatives have been taken to further harmonize criminal codes in Bosnia and
Herzegovina with the aim of suppressing hate speech.
881. The valid laws guaranteeing the right to freedom of thought and expression have been
brought in line with international standards, but still indicators of attacks on journalists and
media professionals needed to be established through the establishment of a database. Bosnia
and Herzegovina was committed to establishing this system as soon as possible.
882. Top priorities were the adoption of the revised National War Crimes Processing
Strategy and the Transitional Justice Strategy, as well as completion of the process of
searching for missing persons, which contributes to reconciliation in and greater
democratization of Bosnia and Herzegovina.
883. The process of harmonization of the laws governing public assembly with European
human rights standards should be completed. On vulnerable groups, strategies and policies
were implemented in Bosnia and Herzegovina aiming at reducing their social exclusion.
There was a lack of financial resources to implement them more effectively. The entity
legislation on labour as well as the legislation concerning the social protection of children in
terms of establishing a system of foster families have been improved.
884. National and entity action plans aimed at protecting women and LGBT community
have been adopted and implemented and policies for the protection of persons with
disabilities and improvements in the situation of Roma and people in the third age are being
implemented.
885. Efforts to prevent segregation and discrimination in education have continued. The
number of “two schools under one roof” has been halved, but it was an obligation of Bosnia
and Herzegovina to eliminate this phenomenon.
886. Bosnia and Herzegovina also faced a major humanitarian challenge due to the
increased influx of migrants. Although the competent authorities in Bosnia and Herzegovina
provided food, sanitary products, clothing and had ensured accommodation for migrants,
greater and systematic assistance from international organizations was needed to adequately
deal with this challenge.
887. Although progress has been made in the implementation of human rights treaties,
Bosnia and Herzegovina was deeply aware of the challenges it faced in building a modern
democratic society. In this regard, Bosnia and Herzegovina will continue with the activities
that ensured the protection of human rights and freedoms of every individual, with a
particular emphasis on vulnerable groups including children, women, refugees and displaced
