A/HRC/42/40/Add.3 Factual editions 1. We propose to substitute the words “State Penitentiary Service” for the words “State Criminal Enforcement Service” in the paragraph 5 of the draft report since starting from September 2016 such a central authority as State Penitentiary Service does not exist in Ukraine. 2. In the third sentence in the paragraph 13 of the draft report quotes must be removed out of words “anti-terrorist operation” because usage of that construction with quotes may cause controversial legal-political interpretation of antiterrorist operation conducting and raise doubts of its lawfulness. Anti-terrorist operation was officially launched by the Decree of Acting President of Ukraine and Head of Ukrainian Parliament “On the Resolution of the National Security and Defense Council of 13 April 2014 “On urgent measures to overcome terrorist threat and maintain territorial integrity of Ukraine” dated 14 April 2014 No. 405/2014 and was legally justified. 3. Rewrite the last sentence in the paragraph 16 of the draft report in the following way: “In 2015, the President of Ukraine approved the National Human Rights Strategy and subsequently the Government approved the relevant Action Plan for the period up to 2020 to implement it”. 4. In the paragraph 22 of the draft report the International Convention on the Protection of the Rights of All Migrants and Members of Their Families should be deleted from the list of mentioned ratified international treaties by Ukraine as far as Ukraine did not ratify that treaty. 5. In the paragraph 28 of the draft report numbers “1461” must be replaced to “146 1” considering that the Criminal Code of Ukraine does not have article 1461. Comments to the certain paragraphs of the draft report 1. Comments to the paragraph 54 on achievements of Ukrainian free legal aid system. “Today Ukraine has developed the system of free legal aid consisting of 550 access points (23 Regional Legal Aid Centres, 96 Local Legal Aid Centres, 433 Legal Aid Bureaus) with 3 thousand lawyers involved, 500 thousand telephone consultations performed and clients` represented in 270 thousand of criminal cases and in 180 thousand of civil cases. Currently, 12 million citizens are potential clients of secondary free legal aid system, of which more than 1.5 million have already exercised their right to secondary free legal aid. Ukraine is further developing the network of justice sphere stakeholders based on five clubs «PRAVOKATOR». It is planned to implement the model of independent legal aid provider for the amalgamated territorial community (ATC). It is also presented online WikiLegalAid Legal Advice Database, containing 1500 consultations. There are other initiatives aiming to ensure the rights of vulnerable groups of citizens, in particular, functioning of family counselors who provide certain categories of vulnerable groups (i.e. IDPs, veterans, women and children - victims of domestic violence and others) with the right to secondary free legal aid. These are the key indicators of free legal aid system performance in 2018.
