14. With regard to subparagraph 2 (g), attention is drawn to the provisions of section VI of
General Assembly resolution 45/248 B of 21 December 1990 and subsequent resolutions, the
most recent of which is resolution 62/236 of 22 December 2007, in which the Assembly
reaffirmed that the Fifth Committee is the appropriate Main Committee of the Assembly
entrusted with responsibilities for administrative and budgetary matters and reaffirmed the role
of the Advisory Committee on Administrative and Budgetary Questions.
9/7. Human rights and indigenous peoples
15. In paragraphs 3, 4, 5 and 6 of draft resolution A/HRC/9/L.17 (adopted as resolution 9/7),
the Council:
(a) Requested the expert mechanism on the rights of indigenous peoples to identify
proposals and to suggest them by consensus to the Council, for its consideration in 2009;
(b) Also requested the expert mechanism and the Special Rapporteur on the situation of
human rights and fundamental freedoms of indigenous people to assist the Preparatory
Committee by undertaking a review and submitting recommendations as contributions to the
outcome of the Durban Review Conference;
(c) Further requested the expert mechanism to prepare a study on lessons learned and
challenges to achieve the implementation of the right of indigenous peoples to education and to
conclude it in 2009;
(d) Requested the expert mechanism on the rights of indigenous peoples to seek input
from relevant stakeholders, including from indigenous peoples’ organizations, Member States,
relevant international and regional organizations, OHCHR, national human rights institutions
and civil society organizations, including non-governmental organizations, for the preparation of
their work.
16. The implementation of paragraphs 3, 4 and 6 would be met by provisions included in the
programme budget for the biennium 2008-2009, under section 23 (Human Rights), in support of
the expert mechanism. Additional appropriations would therefore not be required.
17. With regard to paragraph 5, it is estimated that additional requirements to implement the
activities would amount to $38,900. The requirements, which would provide for general
temporary assistance at the P-3 level for three months to undertake relevant research and
analysis in contribution to the study, have not been included in the programme budget for the
biennium 2008-2009.
18. Although the additional requirements to implement paragraph 5 have not been included in
the programme budget for the biennium 2008-2009, all efforts will be made for them to be met
within the provisions provided, under section 23. No additional appropriations would therefore
be required as a result of the adoption of the resolution.
