Measures taken/current situation
Situation during
the visit
A/HRC/33/51/Ad
d.2
(i) Consider requesting
international support for
forensic investigations and
exhumations as well as for
the ensuing investigations
and prosecutions, which
should be the responsibility
of a transitional justice
mechanism rather than of
the Attorney General’s
Department;
OMP
See response to recommendation 82(f).
ICJ
According to the interim report of the OMP, the Office had consulted with national and
international organisations and experts in order to secure expert knowledge required to
perform specialised tasks such as forensics, tracing, excavations, genetics, legal affairs,
documentation, database management and archiving.
Level of implementation and
observations (to be completed
by the WGEID)
The Working Group notes
information from the OMP that
existing capacity needs to be
strengthened to address the
investigative challenges and reiterates the recommendation to
consider requesting international
support.
Paragraph 8 states that the office sought out the experiences, views, learnings and suggestions
particularly from international institutions – both State and non-State tasked with similar
functions as the OMP.
ITJP
We have offered our extensive library of photos of corpses from the 2008-9 war to the OMP
but there was no response. These pictures could help identify some of the missing and give
some families closure.
(j)
Immediately
open
archives, including military
archives, relevant to cases
of enforced disappearance
in order to facilitate the
localization
of
undiscovered
gravesites
and speed up the search for
missing persons;
Paragraphs 43 44
Government
A provision has been made in the draft framework of Truth and Reconciliation Commission
giving the commissioners access. The provisions have not been enacted as of yet.
In addition to the provisions under the draft TRC framework, an archive is being maintained
on all cases referred to the Government of Sri Lanka by the WGEID, and the Office on
Missing Persons has been provided access to the same.
OMP
See response to recommendation 82(a).
As the need arises the OMP plans to seek access to relevant military archives, in accordance
with its mandate and powers.
Amnesty
Amnesty International is unaware of new efforts on this front.
ICJ
The Working Group notes that
the OMP has access to all state
archives (see response to 79 (e))
and indicates it will seek access
to relevant military archives.
However, the Working Group
regrets that archives that may
contain information on the fate
and whereabouts of disappeared
persons are not public and fully
accessible and calls for them to
be opened immediately.
