The law reform process, including constitutional review, is making little progress.
As no reference was made to the recommendations made by the Truth and Reconciliation
Commission in the review process, crucial recommendations are yet to be implemented.
The issues of the separation of Attorney General from the Ministry of Justice, the removal
of the death penalty from the Constitution, the amendment of discriminatory provisions of
the Constitution and the review of the seditious libel provision of the Public Order Act have
yet to be addressed.
In the area of women’s and children’s rights, customs and traditions continue to bar
full implementation of certain laws, such as the Child Rights Act and the Domestic
Violence Act. Capacity constraints on investigating authorities, the low rate of prosecution,
out of court settlements and interference by traditional leaders in judicial matters continue
to undermine the judicial process, thus creating room for impunity, particularly regarding
sexual and gender-based violence.
In the light of the above challenges, the report concludes with a set of
recommendations for the Government of Sierra Leone and its international partners.
