A/HRC/16/24
2.
The de facto Gaza authorities
88.
In September 2010, the Committee stated it had been unable to substantiate
reports that the de facto Gaza authorities had released all political prisoners or
conducted criminal prosecutions, in response to the FFM report.
89.
The Committee acknowledges that the de facto authorities have now made
efforts to provide specific information concerning criminal investigations into alleged
human rights violations committed by their security forces. The Committee is aware
of the fact that it is not uncommon for such cases to be resolved to the satisfaction of
the families through out-of-court settlements.
90.
Nevertheless, the Committee remains extremely concerned by the fact that the
de facto authorities have not conducted any investigations into the launching of rocket
and mortar attacks against Israel. It considers that the de facto authorities should
make serious efforts to conduct criminal inquiries into all the allegations of grave
violations of international law implicated by these attacks.
