account all circumstances of a given case, incitement to hatred or violence, or violence
against migrant people can be punishable under the Criminal Code.
Since the entry into force of the new Criminal Code and the Fourth Amendment of the
Fundamental Law, it can be concluded that the attitude of the authorities regarding such
criminal offences have been evolving. More and more investigations are initiated, and the
prosecutors and courts are able to establish the liability of the perpetrators in more and more
cases, and prescribing special behavioural rules for the convicts, such as visiting certain
holocaust memorials or reading specific books on the subject.
