Rectification of the legal status of the Committee on Economic,
Social and Cultural Rights: report of the Committee
Note by the Secretariat

The present note is submitted pursuant to Human Rights Council resolution 4/7 entitled
“Rectification of the legal status of the Committee on Economic, Social and Cultural Rights”, in
which the Council decided to initiate a process to rectify, in accordance with international law,
the legal status of the Committee on Economic, Social and Cultural Rights, with the aim of
placing the Committee on a par with all other treaty monitoring bodies. Through this resolution,
the Council requested the Committee to present a report outlining views, proposals and
recommendations on this issue to its last session in 2007.

The Committee on Economic, Social and Cultural Rights, established in 1985 under
resolution 1985/17 of the Economic and Social Council, considered resolution 4/7 of the Council
at its thirty-eighth session, held from 30 April to 18 May 2007. Based on its discussions held at
that session, on 18 May 2007, the Committee communicated its views to the Council through a
letter* from its Chairperson to the Chairperson of the Council.
