With regard to impunity, notably of members of the security forces and the Presidential
Guard, the delegation stated that the Military Criminal Tribunal had been active again since 2003.
At one sitting, it had examined at least 30 cases; and those responsible for crimes of violence and
armed assault were brought to justice and convicted. The country was facing a problem regarding
the enforcement of decisions of the military courts, in particular, because of the existence of
connivance between prison guards, who were military personnel, and prisoners in making escapes.
In that connection, a reform was currently under way to establish a corps of non-military prison
guards. The delegation also referred to the shortage of judges and lawyers, which prevented justice
from being rendered properly. It informed the Working Group of certain reforms, including the
reform of the system of justice and the prison system, involving various ministries. A process of
reflection was under way and implementation deadlines were being established. As an example, the
delegation mentioned prison visits, with the establishment of an observatory. Lastly, it stated that
judicial decisions were handed down against persons responsible for abuses and violations and that
the efforts undertaken since 2003 had led to a decline in the commission of certain offences.

With regard to the crime of witchcraft, the delegation said that that was a cultural problem;
decriminalizing it would be impossible, since that would open the way for private justice.
Nevertheless, action could be taken on the degree of the penalties provided for by the
Criminal Code.

With respect to the death penalty, the delegation indicated that it might be abolished under the
reform of the Criminal Code in October/November 2009, particularly as it was no longer applied.

Concerning extrajudicial executions and racketing, the delegation stated that various decisions
had been taken in connection with illegal barriers that had been re-erected by some members of the
military, with non-suspended prison sentences being handed down. In addition, military personnel
responsible for extrajudicial executions had been brought to justice.
