A/HRC/20/15
•
Be tailored to address the specific occupational health risks faced by
workers in their respective work sectors.
(j)
Ensure that prospective and retrospective accountability mechanisms
are available and accessible to workers. These should include:
•
Social audits;
•
Consumer forums and patient’s rights associations;
•
National human rights ombudsmen;
•
Human rights and health impact assessments;
•
Human rights commissions;
•
Judicial review.
(k)
Incorporate the right to occupational health protections into all free
trade agreements and prioritize the occupational health of workers over trade
concerns. As a part of this process all free trade agreements should undergo a human
rights impact assessment prior to conclusion of the agreement.
(l)
Establish legal and political mechanisms through which transnational
corporations are held accountable for violations of the right to occupational health,
either in the country where the corporation is domiciled or the host country.
(m)
Ensure that all remedies are available and accessible to workers,
including restitution, compensation, satisfaction or guarantees of non-repetition, and
that statutes of limitations do not interfere with access to remedies.
