A/HRC/43/16/Add.1 terminology used, the manner of its implementation, or the proposed time period for implementation. • Non-acceptance of some recommendations may be due to the fact that they are incompatible with the Constitution, the criminal justice system in Egypt, the principle of separation of powers, the principle of equality before the law, or the rights enshrined in international human rights law. • Some recommendations are deemed to contain false allegations due to inaccuracies in their formulation or content. • Two recommendations are deemed to be hostile owing to their inclusion of politicized and erroneous allegations issued by a party that adopts openly hostile positions towards the Government and people of the Arab Republic of Egypt, in contravention of the established principles on which the review process is based. III. The Government’s views on the recommendations made during the universal periodic review cycle are divided into sections based on the subject matter A. Accession to and compliance with international human rights treaties and withdrawal of reservations 6. Article 151 of the Constitution requires the legislative, judicial and executive powers to comply with the provisions of international treaties that have been ratified because they have the same status as domestic legislation. Accordingly, persons who suffer damages from non-implementation of such treaties are entitled to seek legal remedies. As article 93 of the 2014 Constitution accords a special status to ratified international human rights treaties, the rights and freedoms enshrined in such treaties enjoy constitutional protection. All interested parties can resort to the Supreme Constitutional Court to challenge the unconstitutionality of inconsistent legal provisions. The Court has handed down rulings that endorse this principle. In light of the foregoing: • The following recommendations have been accepted: 3, 9, 13, 14, 17 and 18; • The following recommendation has been partially accepted: 73; • The following recommendation is inaccurate: 161; • The following recommendations have not been accepted: 6, 7, 8, 10, 122, 19, 903, 974, 995 and 1156. B. Cooperation with international and regional human rights bodies 7. The Government aspires to participate actively in diverse international and regional human rights forums, and to cooperate with treaty bodies, the Human Rights Council and its special procedures, and the Office of the United Nations High Commissioner for Human Rights (OHCHR). This is borne out by the fact that it hosted a Special Rapporteur in 2018 and has invited six others to visit Egypt. In addition, it seeks to promote civil society’s interaction with the Human Rights Council and its special procedures.
