We replied to a request by OMP in 2018 to share information (most of which was already in
the public domain) and never received a response.
(b) Immediately adopt a
comprehensive policy to
search for all of those who
disappeared;
Paragraph 35
OMP
See response to recommendation 78(b)(i).
Neither the Enforced Disappearances Act nor the Office on Missing Persons (Establishment,
Administration and Discharge of Functions) Act, No. 14 of 2016, (OMP Act) provides for a
specific procedure for finding a disappeared person. The OMP Act provides the OMP with an
explicit mandate to clarify the circumstances in which persons went missing and their fate.70
Further the OMP has specific powers to make rules and develop guidelines in order to
operationalise its mandate.71

This has been brought under the purview of the Office of the Missing Persons as one of the
four objectives of the Office under Section 2 (a) of the Act.
Section 12 stipulates that the Minister of Justice is required to draft guidelines with regards to
searching and the Chairperson of the OMP stated that the guidelines are currently being
prepared in consultation with the Office.
However, the search for victims is yet to begin, which remains one of the primary reasons for
the continued mistrust among families of the disappeared regarding the Office.
